Review of Technology Companies’ Participation in Investigations
摘要: 技术公司参与侦查的实践形态已经突破传统被动参与模式,衍生出抽象委托模式和实质主导模式。抽象委托模式和实质主导模式虽能弥补侦查机关技术短板并提升侦查效能,但会带来一系列风险:造成侦查主体泛化,引发侦查权失控旁落,导致侦查逐利化样态更加复杂、隐蔽,进而影响和冲击侦查权行使的合法性与正当性。治理技术公司参与侦查乱象固然重要,但技术公司参与侦查的正当性问题更具根本性和全局性,尤其在数字化侦查时代,其理论建构的重要性更加凸显。未来应通过激活依靠群众原则,重构第三方主体参与刑事侦查的理论基础,为第三方主体参与侦查提供合法性和正当性,实现刑事司法治理的多元主体协同。
Abstract: The participation of technology companies in criminal investigations has transcended the traditional involvement assistance model, giving rise to abstract delegation models and substantive dominance models. While such models may remedy technological deficiencies in investigative agencies and enhance investigative efficiency, they simultaneously introduce a series of undesirable risks: the proliferation of investigative entities blurs institutional boundaries, the uncontrolled devolution of investigative authority undermines regulatory frameworks, and the emergence of complex and covert profit-oriented practices erodes procedural integrity. Collectively, these challenges jeopardize the legitimacy and justification of investigative power in both legal and operational dimensions. It is undoubtedly important to regulate the involvement of technology companies in investigations, but the issue of their legitimacy in such activities is even more fundamental and overarching. This concern becomes increasingly significant in the era of digital investigations. In the future, efforts should focus on activating the principle of relying on the masses and reconstructing the theoretical foundation for third-party entities’ participation in criminal investigations. This would provide legitimacy and justification for third-party entities’ involvement, ultimately achieving multisubject collaboration in criminal justice governance.
