齐家治国的法治塑造 ——主要基于家庭教育立法的研究

摘要: 习近平总书记关于家庭家教家风建设的系列重要论述，体现了重视家国传统、以新时代的齐家治国推进中国式现代化的特征，是马克思主义与中华优秀传统文化结合的最新成果。现代社会的齐家治国，必然是法治化的齐家治国，而家庭教育作为家庭家教家风的枢纽环节是齐家治国法治化的突破口。在国家层面针对家庭教育进行专门立法，也已经成为中国特色社会主义法治的重要特征。当前，我国的家庭教育立法以儿童为中心，通过立法提升父母对子女家庭教育能力以化解家国困境。但当下的家庭教育立法也具有阶段性、探索性特征，只是齐家治国法治化的开始。未来的家庭教育立法应当从以儿童为中心走向对家庭的整体支持，通过扩展家庭教育立法进一步塑造齐家治国。不仅如此，未来的立法还应突破家庭教育，通过加强家庭的社会性立法，全方位对齐家进行法治塑造，以实现新时代的齐家治国。

Abstract: The series of important remarks and strategic decisions on the family building, family education, and family values made by Xi Jinping, the General Secretary of CPC, reflect the tradition of emphasizing the relationship between family and nation and the characteristic of Chinese-Style modernization advanced through the family harmonization and national governance in the new era, which is the latest achievement in the integration of Marxism with the outstanding traditional Chinese culture. In contemporary society, the family harmonization and national governance must be achieved through rule of law, and the family education, as the pivotal link among family building, family education and family values, is the breakthrough point for advancing the rule of law of family harmonization and national governance. The standalone legislation on family education at the national level has become an important feature of the socialist rule of law with Chinese characteristics. Currently, the legislation of China on family education focuses on children, aiming to enhance parents' abilities in family education through legislation to resolve challenges to families and the nation. However, the current legislation on family education is characterized by its transitional and exploratory nature, marking only the beginning of the rule of law in family harmonization and national governance. The future legislation on family education should evolve from a child-centered approach to providing comprehensive support for families, thereby further advancing family harmonization and national governance through the expansion of legislation on family education. Moreover, the future legislation should go beyond family education, and through strengthening legislation on family-related social matters, develop rule of law in family harmonization in all-round manner, so as to realize the family harmonization and national governance in the new era.
