范式的转向：党内法规党外效力证成范式的学说演进与反思

摘要: 学界对党外效力证成范式的发展，经过了间接影响论、宪制逻辑论、社会系统论和党政关系论四重范式的转向。党外效力初次进入人们的理论视野时，学界将党外效力归因于间接影响力。不满足于形式化归因的学者从不成文宪法和宪法文本的角度，阐述党外效力在宪制层面的正当性。也有学者引入社会系统理论，认为党外效力是党内法规系统与国家法律系统耦合运作的结果。但上述三种进路均只是将党内法规套入已有的理论与规范当中，并未真正去思考党外效力发生的土性缘由。因此秉持建构态度的学者从我国的党政关系出发，建构本土化的证成范式。然而，无论何种进路，在理论供给侧均无法满足证成的需求，或与党内法规实践相脱节，或存在逻辑上的矛盾，或是在证成性、说服性与方法科学性上有待商榷。文章总结反思了不同进路的优缺点，认为只有从党内法规生长的本土逻辑与自我指向中才能建构出一套符合党外效力证成需求的理论逻辑。
 

Abstract: The development of the external effect of the party has gone through the transformation of the fourfold paradigm of indirect influence theory, constitutional logic, social system theory and party-government relationship theory, and each paradigm corresponds to a different logical path. When extra force first entered people’s theoretical horizons, academics attributed extra force to indirect influences such as spillover effects and the nature of soft law. Scholars who are not satisfied with formal attribution take a serious attitude and explain the legitimacy of extra-party validity in the constitutional sense from the perspectives of the unwritten constitution and the constitutional text. Some scholars also uphold an open attitude and introduce the theory of social systems, arguing that the effectiveness of the party outside the party is the result of the coupling operation of the party’s internal legal system and the national legal system. However, the above three approaches only put the party’s internal laws and regulations into the existing theories and norms, and did not really think about the local reasons for the occurrence of effectiveness outside the party. Therefore, according to the special realistic context of the party’s internal regulations, scholars with a constructive attitude construct a localized approach to the certification of the party from the perspectives of the party-government relationship such as the division of labor between the party and the government, the relationship between law and government, and the theory of embeddedness. However, no matter what approach is taken, it cannot meet the demand for proof on the supply side of theory, or it is out of touch with the practice of internal party regulations, or there are logical contradictions, or it is debatable in terms of proof, persuasiveness and scientific methodology. This paper summarizes and reflects on the advantages and disadvantages of different approaches, and argues that only from the local logic and self-orientation of the growth of intra-party regulations can a set of theoretical logic that meets the needs of effectiveness certification outside the party be constructed.
