行政行为设定制度在行政基本法典中的去留

摘要: 行政基本法典的编纂必须吸收既往立法中创设的行之有效的法律制度。行政处罚法创设的行政行为设定制度本质上是对行政行为设定权的配置，是对我国立法权配置制度的重大发展和补充，编纂行政基本法典时是否吸收这一制度值得研究。行政基本法典是关于一般或基本行政法的法典，以规范行政行为为中心。在行政基本法典中规定行政行为设定制度符合其定位，有助于法律保留原则或职权法定原则的实现。不过，行政行为设定制度具有显著的身份等级性，会导致立法主体之立法任务与立法手段不相匹配，且统一划分所有行政行为的设定权在技术上存在困难。为此，行政基本法典虽可保留行政行为设定制度，但只能按法律保留原则划分法律与法规之间的行为设定权，进一步的具体划分可交由单行法或部门法来酌情完成。

Abstract: The codification of the Administrative Basic Code must absorb the proven legal system created in previous legislation. The Administrative Penalty Act created the establishment rule of administrative acts is essentially the arrangement of the administrative act establishing power, is a major development and supplement to the legislative power dividing of our country. It is worth studying whether this system should be absorbed when codifying the Administrative Basic Code. The Administrative Basic Code is a code of general or basic administrative law, centering on the regulation of administrative acts. Providing for the establishment rule of administrative acts in the Administrative Basic Code is in line with its position and helps to realize the legal reservation principle or the principle of power prescribed by law. However, the hierarchical nature of the administrative act establishment rule may lead to a mismatch between the legislative task of the legislative body and the legislative means, and it is technically difficult to uniformly classify the establishment rule of all administrative acts. For this reason, although the Administrative Basic Code may retain the establishment rule of administrative acts, it can only divide the power of enacting between laws and regulations in accordance with the legal reservation principle, and further specific division can be left to the discretion of inferior laws to complete.
