中华优秀传统法律文化的传承发展逻辑

摘要: 在当代中国,中华优秀传统法律文化是中国式法治现代化和中华民族伟大复兴的源头活水和文化根脉。中华优秀传统法律文化具有内容上的原创性、形态上的连续性、发展上的创新性、功能上的统一性和价值上的包容性。中华优秀传统法律文化的思想精髓包括出礼入刑、隆 礼重法的治国策略,民惟邦本、本固邦宁的民本理念,天下无讼、以和为贵的价值追求,德主刑辅、明德慎罚的慎刑思想, 援法断罪、罚当其罪的平等观念, 保护鳏寡孤独、老幼妇残的恤刑原则。“两个结合”是传承发展的根本遵循；坚持文化主体性是传承发展的基本立场；创造性转化与创新性发展是传承发展的基本方法。中华优秀传统法律文化的历史使命是为中国式法治现代化培植文化底蕴,为中华民族伟大复兴树立法治自信。

Abstract: In contemporary China, China’s fine traditional legal culture is the culture source and root of Chinese path to modernization of the rule of law and the great rejuvenation of the Chinese nation. China’s fine traditional legal culture has originality in content, continuity in form, innovation in development, unity in function, and inclusiveness in value. The ideological essence of China’s fine traditional legal culture includes governance strategy of enforcing public discipline through the application of both morality and law, the people-centered concept that the people are the foundation of a state and only when the foundation is solid will the state be stable, the wish for social harmony without lawsuits, the idea of prudence that prioritizes moral enlightenment over legal punishment, the concept of equality that advocates passing judgment in accordance with the law and ensures that the punishment fits the crime, and the principle of leniency towards widowers, widows, orphans, child-less couples, the elderly, children, women, and people with disabilities. The adaptation of the basic tenets of Marxism to China’s specific realities and its fine traditional culture is the fundamental principle of carrying forward and developing China’s fine traditional legal culture. Adherence to the identity of the Chinese culture is the basic standpoint for the inheritance and development. Creative transformation and development is the basic method of inheritance and development. The historic mission of China’s fine traditional legal culture is to cultivate cultural heritage for the Chinese path to modernization of the rule of law and to establish the confidence of the rule of law for the great rejuvenation of the Chinese nation.
