司法研究、司法决策、司法实践的界面管理与协同效应

摘要: 司法研究和司法实践是司法决策的基础; 司法实践是司法决策的目标指向; 司法决策是司法研究走向司法实践的中介; 司法研究与司法决策的质量影响司法实践的效果。司法研究、司法决策、司法实践三者之间是一种复杂的界面关系，三者之间存在着任务界面障碍、沟通界面障碍、管理界面障碍、人力资源界面障碍和文化资源界面障碍等。根据系统论和协同学原理，在有效的内部控制和外部干预下，可以实现三者之间包括任务整合、沟通整合、管理整合、人力资源整合、文化资源整合、奖惩机制整合在内的界面整合，使三者产生协同效应，进而有助于司法责任制的全面准确落实。

Abstract: Judicial research and judicial practice are the basis of judicial decision-making. Judicial practice is the goal of judicial decision-making; Judicial decision is the intermediary from judicial research to judicial practice; The quality of judicial research and judicial decision-making affects the effect of judicial practice. There is a complex interfacial relationship among judicial research, judicial decision and judicial practice, among which there are task interfacial barrier, communication interfacial barrier, management interfacial barrier, human resource interfacial barrier and cultural resource interfacial barrier. According to the principles of system theory and synergetic science, under effective internal control and external intervention, interface integration including task integration, communication integration, management integration, human resources integration, cultural resources integration, reward and punishment mechanism integration can be achieved among the three, so as to produce synergistic effects among the three, and further contribute to the comprehensive and accurate implementation of the judicial responsibility system.
