我国自贸区（港）数据跨境流动安全协同治理的内涵、分歧及因应——基于“公私合作伙伴关系理论”模型

摘要: 摘  要：[目的/意义]建立健全我国高效便利安全的数据跨境流动机制，在自贸区（港）数据跨境流动中引入“公私合作伙伴关系（Public-Private-Partnership，简称“PPP”）”协同治理模式，促进国家数字经济繁荣发展与全球数字经济的深度融合，从而保障数据跨境流动安全。[方法/过程]通过“文献综述、内容分析、模型构建”等研究方法，在厘清“PPP”模式协同治理内涵基础上，进一步分析实践运行面临“政府角色的结构性错位、企业数据合规的利益冲突、公众认知的偏差导致信任危机”的“三重”分歧。[结果/结论]通过“政府角色的转型；企业技术创新驱动数据合规；公众参与意识的提升与监督反馈”3个维度开展深度合作，期冀构建全方位、多层次的数据跨境流动安全协同治理体系，为自贸区（港）数据跨境流动安全协同治理提供了新的思路与实践路径。
 

Abstract: Abstract: [Objective/Significance] Establish and improve China’s efficient, convenient and secure cross-border data flow mechanism, and introduce the "Public-Private-Partnership" (PPP) collaborative governance model in the cross-border data flow in the Free trade zone (port). Promote the deep integration of the prosperity and development of the national digital economy with the global digital economy, so as to ensure the security of cross-border data flow. [Method/Process] Through the research methods of "literature review, content analysis, model construction", and other research methods, on the basis of clarifying the connotation of "PPP" mode collaborative governance, the paper further analyzes the "triple" differences faced by the practice of "structural dislocation of government role, conflict of interest in enterprise data compliance, and deviation of public cognition leading to trust crisis". [Result/Conclusion] Through the "transformation of the role of government; Enterprise technology innovation drives data compliance; To carry out in-depth cooperation in the three dimensions of public participation awareness enhancement and supervision feedback, we hope to build a comprehensive and multi-level collaborative governance system for cross-border data flow security, providing new ideas and practical paths for the collaborative governance of cross-border data flow security in the Free trade zone (port).
