Functional transformation and improvement of "soft and hard co-governance" in educational administrative law enforcement in the new era
摘要: 在教育“双减”政策的持续推动下,教育行政执法在综合行政执法改革过程中形成了新型的执法力量。传统意义上,教育督导等带有“柔性”规制效果的监督检查手段逐步朝着专项和综合执法转型。柔性督导主要表现在“行为模式”中对“法律后果”规制的“软性”规定。而教育行政执法是教育督导职能在特定场域的延伸。在现代执法“软硬共治”的理念转型下,教育的“软法”功能是市场资源配置规律的内在反映,而教育执法的“硬法”功能则是教育市场监管秩序规制的外在表现。未来立法应明确教育行政综合执法中的“软法”属性范畴,推动形塑教育行政“软硬共治”的综合执法模式,完善教育行政执法的规范依据以及优化教育行政执法的程序衔接规则。
Abstract: With the continuous promotion of the policy of "double reduction" in education, educational administrative law enforcement has formed a new law enforcement force in the process of comprehensive administrative law enforcement reform. Traditionally, educational supervision and other means of supervision and inspection with "flexible" regulatory effect have gradually transformed into special and comprehensive law enforcement. Flexible supervision is mainly manifested in the "soft" regulation of "legal consequences" in "behavior mode" The educational administrative law enforcement is the extension of the educational supervision function in a specific field. Under the transformation of the concept of "soft and hard governance" in modern law enforcement, the "soft law" function of education is the internal reflection of the law of market resource allocation, while the "hard law" function of education law enforcement is the external expression of the regulation of education market supervision order. In the future, legislation should clarify the category of "soft law" in the comprehensive law enforcement of educational administration, promote the comprehensive law enforcement model of "soft and hard governance", improve the normative basis of educational administrative law enforcement and optimize the procedural convergence rules of educational administrative law enforcement.
