被遗忘权对网络信息存档的影响及平衡路径

摘要: [目的/意义]记忆与遗忘一体两面，在被遗忘权逐渐成为国际趋势的背景下，探究被遗忘权对网络信息存档的影响及平衡路径对于网络信息存档工作的开展具有重要意义。[方法/过程]基于系统的文献研究，探究被遗忘权的成因，分析被遗忘权在网络信息存档过程中对集体记忆的建构和个人信息的保护的影响，最后以信息生命周期为视角，思考时间、利益与被遗忘权的平衡路径以及例外情况。[结果/结论]被遗忘权是与时间要素密切相关的权利，在信息生命周期视角下，存档机构应考虑在一般情况、公共场景、档案开放利用或档案信息脱敏影响下档案信息价值随时间的变化，在此基础上做出取舍判断，并对特殊来源的信息存档行为进行豁免。

Abstract: [Purpose/significance] Memory and forgetting are two sides of the same coin, and in the context of the right to be forgotten gradually becoming an international trend, it is of great significance to explore the impact of the right to be forgotten on web archiving and the path to balance for the development of web archiving. [Method/process] Based on systematic literature research, this paper explores the causes of the right to be forgotten, analyses the impact of the right to be forgotten on the construction of collective memory and the protection of personal information in the process of web archiving, and finally considers the path of balancing time, interests and the right to be forgotten, as well as exceptions to the right to be forgotten, from the perspective of the information life cycle.[Result/conclusion] The right to be forgotten is a right closely related to the element of time, and under the perspective of the information life cycle, archiving institutions should consider the changes in the value of archived information over time under the influence of general cases, public scenarios, archival access and use, or desensitization of archived information, and make trade-off judgements on this basis, as well as exemptions from the act of archiving information from special sources.
