数字赋能检察侦查模式的进路

摘要: 随着数字检察战略的深化推进，检察侦查模式的数字化转型正悄然发生，并为检察侦查工作的创新发展描绘出崭新蓝图。然而，当前相关程序规则的供给面临瓶颈，使得数字赋能检察侦查模式在某种程度上趋同于线索情报活动，引发检察侦查对象扩大化、检察侦查决策智能化化、检察侦查方式隐蔽化、检察侦查程序形式化等制度性风险，难以充分保障犯罪嫌疑人的合法权益。为兴利避害，数字赋能检察侦查模式的完善应当防范数字检察的不当或泛化使用风险，从数字赋能结构、侦查活动的程序规制以及类案指引等方面实现数字检察赋能的规范化，实现检察履职与尊重人权的统一。

Abstract: With the deepening of the digital prosecutorial strategy, the digital transformation of the prosecutorial investigation mode is quietly taking place, and it has drawn a new blueprint for the innovative development of prosecutorial investigation work. However, the current supply of relevant procedural rules is facing a bottleneck, which makes the digital empowerment procuratorial investigation model converge to clue intelligence activities to some extent, causing institutional risks such as the dispersion of procuratorial investigation objects, the automation of procuratorial investigation operations, the concealment of procuratorial investigation methods, and the falsification of procuratorial investigation procedures, which are difficult to fully protect the legitimate rights and interests of suspect. In order to promote benefits and avoid harm, the improvement of the digital empowered prosecutorial investigation model should prevent the risks of improper or generalized use of digital prosecutorial methods. Standardization of digital prosecutorial empowerment should be achieved from the aspects of digital empowerment structure, procedural regulation of investigative activities, and case guidance, to achieve the unity of prosecutorial performance and respect for human rights.
